The Satanic Temple argued a religious right to abortion.
U.S. District Judge David Nye ruled against The Satanic Temple in its lawsuit against the law banning abortion in the state of Idaho. He dismissed the case with prejudice, meaning the suit cannot be refiled, after the Ninth Circuit Court of Appeals stated the Massachusetts-based organization lacked standing and remanded the case back to Judge Nye.
The judge refuted the organization’s legal arguments that claimed abortion is a religious rite and a sacrament under the First Amendment.
Judge Nye found, “No amendment could change the Court’s holding because the Court’s reasoning was based on the sheer unworkability of TST’s arguments as applied to the constitutional context. TST’s efforts to shoehorn its disagreements with Idaho’s abortion statutes into constitutional claims rang of the classic phrase ‘trying to fit a square peg in a round hole.’ It simply does not work.”
